These Terms and Conditions shall apply to all contracts entered into by Signity Incorporated. By placing your order with us you are accepting these Terms and Conditions. Where you do not accept these Terms and Conditions in full, you do not have permission to access the contents of this website and should cease using it immediately. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms & Conditions”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms & Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. Our store is hosted on WooCommerce. They provide us with the online e-commerce platform that allows us to sell our products, businesses, and services to you.
SITE ACCESS AND CHANGES
Our website changes regularly and access to this site is permitted on a temporary basis. We aim to update our site regularly and may change the content at any time, including the product details and pricing without notice. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material. You are also responsible for ensuring that all persons who access our site through your Internet connection are aware of these terms and that they comply with them.
No contract will exist between you and Signity Incorporated for the sale of any product unless and until Signity Incorporated through its website signity.ph has accepted your order with a confirmation email. Our acceptance of your order brings into existence a legally binding contract between us. Signity Incorporated reserves the right not to accept your order in the event that we are unable to obtain authorisation for payment, if shipping restrictions apply to a particular item, if the item ordered does not meet our quality control standards and is withdrawn, out of stock or if there is an error in pricing or content. We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable for any indirect or consequential loss, damage or expenses arising from not accepting your order and we shall have no liability to you, by way of compensation, other than to refund the amount paid for the goods in question.
The prices payable for ordered goods are as set out in our website in pesos ( Philippine currency). All prices are non – inclusive of the Philippine VAT. Order total does not yet include the shipping fee.
Unless you cancel your order within 7 working days after full payment has been made, acceptance of your order and completion of the contract between you and Signity Incorporated will be completed when the goods have been dispatched. To cancel your contract, you must notify us of your decision by email here using the subject heading ‘Cancellation’ and supplying your order number and address. Any returns after the 7 days period stated above, will be at the discretion of Signity Incorporated.
DEFECTIVE AND DAMAGED ITEMS
All parcels must immediately be opened in the presence of the Courier upon receipt of the goods, to verify that the Goods are contained in the parcel are untampered with and undamaged. You acknowledge that if you fail to do this and subsequently find the Goods are not contained therein or have been damaged during delivery, we may not be able to claim against the Courier or against our insurers. Accordingly, if you do fail to do this, you agree that you will be solely liable for any such loss or damage and shall waive, release and indemnify us from and against any claims relating thereto, to the fullest extent permitted by applicable law. If you should receive an item that is defective, damaged or not what you ordered, please contact us here within 7 working days. We will help you resolve any issues as quickly as possible by replacing the item, once the faulty item has been returned to us by post. We will confirm the return address in writing, once you have contacted us about the fault.
REFUNDS AND EXCHANGES
In the unlikely event that you are unhappy with your order please don’t hesitate to contact us here. Each piece of Signity Incorporated is made to order, customized or personalized, therefore we cannot offer a refund on a piece unless it is found to be faulty. In certain circumstances, we may be able to offer an exchange for another piece. Upon receipt of items, the Paypal account, credit or debit card originally used for the purchase will be credited with the cost of the goods minus the delivery charges (exceptions may apply). We will process your refund within 48 hours of receipt. Your credit card company may take 4-7 working days to credit your account. These Terms and Conditions, and the registration form submitted (whether via online or otherwise) by the subscriber/member shall form the full agreement between the subscriber/member and Signity Management (“Agreement”).
REFUNDS AND EXCHANGES
The Management may amend and update these Terms and Conditions and/or the Specific Terms and Conditions from time to time. The Management may give notice of such amendments or updates in any manner it deems appropriate which shall include online publication continued participation in any classes or membership shall signify the subscriber’s/membership acceptance to the changes and updates to these Terms and Conditions and/or the Specific Terms and Conditions.
1. Subscription Terms
1.1 Subscription is personal to the subscriber/member and is non-assignable, non-transferable and non-refundable. A subscriber may not pass on his/her course reservation to be used by a third party.
1.2 All new subscriptions/memberships are subject to the approval of the Management. The Management of Signity reserves the right to reject an application for any reason whatsoever.
2. Billing and Payments
2.1 Subscribers/Members shall be charged according to the type of membership subscribed or offered.
2.2 Full payment of fees upon membership registration is required to confirm participation.
2.3 Cancellations and refunds. No refunds of any payment made shall be permitted. Payment of any fees shall be forfeit if a Subscriber/member cancels their registration/application.
3. Subscriber’s / member’s Responsibilities
3.1 All subscribers/members shall:
3.1.1 promptly pay all amounts due to the Management as billed;
3.1.2 comply with all rules, notices or directions issued by the Management from time to time.
4. Termination and Consequences of Termination
4.1 The Management may terminate a subscriber’s subscription/membership:
4.1.1 without notice and with immediate effect if a subscriber’s /member’s conduct, whether or not such conduct is the subject of complaint by another subscriber/member, is such that in the reasonable opinion of the Management, it is harmful to the character and/or interests of the Management;
4.1.2 without notice and with immediate effect if the subscriber/member shall have committed any breach of any rules or directives imposed by the Management from time to time; or
4.1.3 with seven (7) days’ notice if any invoice remains outstanding after the due date or where these Terms and Conditions have been breached and such breach is not rectified within the time stipulated by the Management.
4.2 Upon termination of a subscriber’s /member’s application, such shall become immediately liable for any and all outstand ing amounts owed to the Management.
5. Disclaimer and Limitation of Liability
5.1 The Management shall not be liable for any loss and/or damage whether direct, indirect, consequential, incidental, punitive, aggravated or exemplary, including, without limitation, loss of profit, lost savings, and loss of revenues suffered by a subscriber/member or any third party or any injury caused to or suffered by a person or damage or loss to property arising from or occasioned by:
5.2 The subscriber/member agrees that no claims will be made against the Management or its employees for any reason whatsoever. The Subscriber/member hereby holds the Management and its employees harmless from all claims which may be brought against them by or on a subscriber’s behalf for any aforementioned claims.
6. Media Consent
6.1 The subscriber/member hereby grants to the Management the absolute and irrevocable right and unrestricted permission concerning any photographs and videos that the Management has taken or may take of the subscriber or in which the subscriber may be included with others, to use, reuse, publish, and republish the photographs and videos in whole or in part,individually or in connection with other materials, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration.
6.2 The subscriber/member releases and discharges the Management from any and all claims and demands that may arise out of or in connection with the use of the photographs and videos, including but without limitation to any and all claims for libel or violation of any right of publicity or privacy including under the Personal Data Protection Act 2010. This authorisation and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of the Management. This release shall be binding upon the subscriber and his/her heirs, legal representatives, and assigns.
7.1 Governing Law This Agreement is governed by the laws of the Philippines and the parties submit to the exclusive jurisdiction of the Philippine courts.
7.2 Severability If any provision in this Agreement shall for any reason be held to be unenforceable, illegal or invalid in any respect, such unenforceability, illegality or invalidity shall not affect other provisions of this Agreement and this Agreement shall then be construed as if such unenforceable, illegal or invalid provision had never been contained herein.
7.3 Deemed Acceptance The subscriber/member is deemed to have accepted the terms herein by:
7.3.1 submitting a registration for any membership; or
7.3.2 participating in / attending any events, offered by the Management.
Membership Specific Terms and Conditions
The following membership specific terms and conditions (“Specific Terms and Conditions”) shall apply where the subscriber /member has subscribed to any membership options offered by Signity Management and shall be read in addition to the Terms and Conditions above.
1. Membership Categories and Fees
1.1 The Management offers the following categories of membership here
1.2 Memberships shall only be activated on the date of payment of the first Annually Membership Fee or the Upfront Membership Fee, whichever is applicable.
1.3 Membership Fees shall be payable in advance at the beginning of each calendar month through the available payment methods offered by the Management.
1.4 Where applicable, members may opt to pay an Upfront Membership Fee for the next three (3 ) to five (5) years instead of the yearly Membership Fee.
1.5 Failure to utilize any membership benefits to any member shall not impose a problem to the Management.
1.6 The Management may terminate the subscriber’s/member’s membership where yearly Membership Fees remain unpaid f or two (2) years or more.
1.7 A subscriber /member may terminate his/her membership at any time by giving the Management at least thirty (30) days prior with a written notice.
The entire content of this website, including all jewelry designs, services, businesses, home servicing, all its photographs, logo, copyright, trademarks, and other intellectual property rights it contains, including the use of the name Signity Incorporated or Signity Business is the sole property of Signity Incorporated. You may store, print and display the content supplied solely for your own personal use and you may draw the attention of others within your organization to material posted on our site. You are not permitted to manipulate, or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this website nor may you use any such content in connection with any business or commercial enterprise.
